Please read these Terms & Conditions (“Terms”) carefully before placing an order or using the website 100flowersllc.com (the “Site”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Products & Availability
All products are subject to availability. Fresh flowers are perishable and availability varies based on season, supply, and daily inventory. We reserve the right to substitute flowers or foliage of equal or greater value and similar style when a specific variety is unavailable, without prior notice. Substitutions will always maintain the overall color palette and design intent of the arrangement.
Product images on the Site are representative. Actual arrangements may vary slightly in color, size, and shape due to the natural variation of fresh flowers and the handcrafted nature of our designs.
3. Pricing & Payment
All prices are listed in US Dollars (USD) and are inclusive of California state sales tax (7.25%) unless otherwise stated. Prices are subject to change without notice. Your order total will be confirmed at checkout before payment is submitted.
Payment is processed at the time of order placement. We accept Visa, Mastercard, American Express, Discover, and other cards supported by Stripe. We do not accept cash-on-delivery for online orders.
In the event of a pricing error on the Site, we reserve the right to cancel any orders placed at the incorrect price and issue a full refund.
4. Order Confirmation & Acceptance
Placing an order constitutes an offer to purchase. Your order is not accepted until you receive an email confirmation from us. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, errors in product or pricing information, or product unavailability. If we cancel your order, you will receive a full refund.
5. Delivery Policy
- Delivery Area: We deliver within El Cajon and the greater San Diego area. Delivery outside our standard zone may be unavailable or subject to additional fees.
- Same-Day Delivery: Orders placed by 2:00 PM (PST) Monday through Saturday may qualify for same-day delivery. Orders placed after the cutoff, on Sundays, or on holidays will be scheduled for the next available delivery date.
- Delivery Hours: Monday–Saturday 8:00 AM–8:00 PM; Sunday 9:00 AM–8:00 PM.
- Delivery Address: It is your responsibility to provide a complete and accurate delivery address, including any apartment number, gate code, or special instructions. We are not responsible for failed deliveries due to incorrect or incomplete address information.
- Recipient Availability: If the recipient is unavailable at the time of delivery, our driver may leave the arrangement in a safe, shaded location, with a neighbor, or at the front desk. We will make reasonable efforts to contact you or the recipient. We are not responsible for damage to arrangements left unattended.
- Delivery Confirmation: Delivery is confirmed when the arrangement is left at the recipient address. We are not liable for theft or damage after delivery.
6. Perishable Nature of Products
Fresh flowers are perishable. Their lifespan depends on care, environmental conditions, and the specific varieties used. We guarantee freshness at the time of delivery. We are not responsible for flowers that wilt or deteriorate due to heat exposure, failure to water, improper placement, or care after delivery. Care instructions are included with every arrangement.
7. Cancellations & Modifications
- Cancellations: Orders cancelled at least 24 hours before the scheduled delivery date are eligible for a full refund. Orders cancelled less than 24 hours before delivery are not eligible for a refund as the arrangement will have already been prepared.
- Same-Day Orders: Same-day orders cannot be cancelled once confirmed, as the arrangement is prepared immediately upon order acceptance.
- Modifications: Requests to modify an order (delivery date, address, or product) must be submitted at least 24 hours in advance. We will accommodate modifications where possible but cannot guarantee changes for same-day orders.
8. Refunds & Replacements
Our goal is your complete satisfaction. If you are not satisfied with your order, please contact us within 24 hours of delivery with a photo of the arrangement. We will, at our discretion:
- Replace the arrangement at no charge;
- Issue a store credit; or
- Issue a partial or full refund.
Refund requests made more than 24 hours after delivery will not be accepted. We do not issue refunds for arrangements that have been damaged due to improper care after delivery, or where the complaint is based solely on personal preference of flower variety (where a disclosed substitution was made).
Refunds are processed within 5–10 business days to your original payment method.
9. Gift Messages & Personal Data of Recipients
When you provide a recipient’s name, address, and a personal message, you represent that you have the right to share that information and that the recipient consents to receive the delivery. We use recipient information solely to fulfill the order and do not use it for any other marketing purpose.
10. Intellectual Property
All content on this Site — including text, graphics, logos, images, product photography, and design — is the property of 100 Flowers & Gifts LLC or its content suppliers and is protected by applicable US copyright and trademark law. You may not reproduce, distribute, or use any content from this Site without our prior written consent.
11. User Accounts
If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts at our discretion.
12. Limitation of Liability
To the fullest extent permitted by California law, 100 Flowers & Gifts LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or products, including but not limited to loss of profits, loss of data, or personal injury caused by reliance on any product. Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the specific order giving rise to the claim.
We are not liable for delays or failures in delivery caused by circumstances beyond our reasonable control, including but not limited to severe weather, road closures, natural disasters, or supplier shortages.
13. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be submitted to binding arbitration in San Diego County, California under the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
To the extent permitted by law, you waive any right to participate in a class-action lawsuit or class-wide arbitration.
15. Indemnification
You agree to indemnify, defend, and hold harmless 100 Flowers & Gifts LLC, its officers, members, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any third-party rights.
16. Changes to These Terms
We may update these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
